Today’s challenges as an employer of any size require the
knowledge of and ability top manage issues related to the new
and evolving American with Disabilities Act accommodations
requirements. As behavioral health professionals we are
specifically trained in techniques to teach and manage
compliance issues as they surface in the workplace. We can be
utilized in the training and education of your management and
line supervisors enabling the to define appropriate
accommodations and provide them with sensitivity training in
relation to their communication with their employees.
We will teach supervisors how to communicate with their employees
in the identification of accommodation needs as well as to define
exactly what appropriate accommodation is required by law and
condition. We will teach supervisors how to perform ongoing monitoring
of each specific situation to ensure the continuous appropriateness
of the accommodation. As employee needs change, so might the accommodation
required. Supervisors will be trained to do the proper follow
up as well as how to work with the employee to seek changes as
needed. Additionally, supervisors will be trained to be sensitive
to the recognition and identification of potential signs of stress
and distress among employees to prevent conflict whenever possible.
Supervisors will be taught proper record keeping measures to ensure
that personnel records contain only appropriately written accounts
of activities pertaining directly to the organization’s policy
statements and the employee’s job description.
This training requires not only a lecture formatted workshop
to train supervisory personnel, but the ongoing availability of
consultation with us and our legal advisor, a consultant who
specializes in this complex, specific and evolving area of the
law.
In addition, we will ,for the employer, perform an evaluation
of the employee to substantiate if there is a disability. We
then will advise and recommend appropriate accommodations as
required.
